1. Acceptance of Terms
These Terms & Conditions ("Terms") govern your access to and use of Mums Club KE's mobile application and related services (the "Service"), operated by Exciteric Int ("we", "us", "our"). By creating an account, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service. Some features (KaziConnect and FitMums KE) have extra rules in Sections 9 and 10, which apply when you use those features.
2. Eligibility
- You must be at least 13 years old to use the Service, and you must give accurate registration information, including your real date of birth.
- KaziConnect and FitMums KE are only for adults aged 18 or over. We check this against the date of birth on your account.
- If you use the Service on behalf of an organization (for example, administering a group), you confirm you have authority to bind that organization to these Terms.
3. Account Registration & Security
- You're responsible for keeping your password and wallet withdrawal PIN confidential, and for all activity under your account.
- Notify us immediately if you suspect unauthorized access to your account.
- Usernames must be 3–20 characters (letters, numbers, underscores) and must not impersonate another person or brand.
- You may hold only one account. We may suspend or terminate accounts that give false information or break these Terms (see Section 12).
4. Description of Service
The Service includes, among other things: a social feed with posts, reels and stories; groups with optional paid subscriptions; a direct-messaging inbox; events; Safe Space peer support; KaziConnect, a marketplace where mums and househelps find each other; FitMums KE, a community fitness and nutrition challenge; an in-app wallet with M-Pesa deposits and withdrawals; paid boosts; and periodic contests and promotions. We may add, change, or remove features at any time.
5. Wallet & Payments
Your in-app wallet holds a balance in Kenyan Shillings (KES) that you can top up via M-Pesa and use across the Service (subscriptions, boosts, etc.), or withdraw back to M-Pesa. The following terms apply to withdrawals, and reflect our current configuration exactly:

- Withdrawals require your 4-digit wallet PIN and are subject to admin approval before the M-Pesa payout is sent.
- We are not responsible for delays or failures caused by Safaricom's M-Pesa network; a failed withdrawal is refunded to your wallet.
- We may change the minimum withdrawal amount, service fee, or tax rate at any time — the figures shown above always reflect the current configuration.
- Wallet balances are not bank deposits, are not interest-bearing, and are not insured or guaranteed by any government deposit insurance scheme.
- KaziConnect and FitMums KE are currently free to use. Wages agreed through KaziConnect are paid directly between employer and househelp, never through the wallet.
6. Group Subscriptions
Each paid subscription payment is currently split as follows:

- Subscriptions grant access to a specific group's content/tier for the period stated at purchase and do not automatically renew unless the app indicates otherwise at checkout.
- Group admins are independent users, not our employees or agents — we do not control, and are not responsible for, the content or conduct of any individual group or its admin.
- Subscription payments are generally non-refundable except where required by law or expressly stated at the time of purchase.
7. Boosts & Sponsored Content
Post and group "boosts" let you pay to increase a post's or group's visibility to a targeted audience (by campus, gender, age range, or county) for a limited period shown at purchase. Boost fees are paid from your wallet and are non-refundable once the boost period has started, except where required by law.
8. Contests & Promotions
From time to time we run in-app contests and promotions. For each contest or promotion:
- Specific eligibility rules, submission windows, and prize amounts are shown in-app and form part of these Terms for that contest.
- Prizes are credited to your in-app wallet and are subject to the withdrawal terms in Section 5.
- We may modify, suspend, or cancel a contest or promotion at any time, including for suspected fraud, abuse, or technical error, and our decisions on submissions, scoring, and winners are final.
- You retain ownership of content you submit to a contest, but grant us the license described in Section 13 to use it as part of operating and promoting the contest.
FitMums KE leaderboards and badges are covered by Section 10.4, not this section.
9. KaziConnect (Househelp Marketplace)
9.1 What KaziConnect is — and isn't
- KaziConnect helps people looking for a househelp or domestic worker ("employers") and people looking for domestic work ("househelps") find and contact each other, through profiles, job posts, interview requests and applications.
- We are not an employment agency, recruiter or employer, and we are not a party to any agreement you make with another user. We don't employ, supervise, place, or guarantee any househelp, and we don't guarantee that any employer or job is genuine or suitable.
- Any employment relationship is between the employer and the househelp alone. Employers are responsible for complying with Kenyan employment law, including paying at least the applicable statutory minimum wage, giving a written contract where required, making statutory deductions and contributions (such as NSSF, SHIF and the Housing Levy), and respecting leave, rest days and notice rules.
9.2 Roles and accounts
- You choose to use KaziConnect either as an employer or as a househelp. You must use the role that's true for you.
- Househelps must be at least 18. The age on a househelp profile must match the date of birth on the account.
- Everything on your profile, job post or application must be true and about you. Don't create profiles for other people, and don't use someone else's photo.
9.3 Verification
- Househelp profiles are reviewed by our team before employers can see them, and we may contact a referee. A "Verified" badge means only that this review took place.
- Verification is not a police, criminal-record, identity-document, health or employment-history check. Employers must make their own checks, including calling referees and seeing original documents in person, before hiring anyone.
- We may decline, ask for changes to, suspend or remove any profile, job post or application, at our reasonable discretion — for example if it seems inaccurate, unsafe or in breach of these Terms. Changing your name, photo, age, phone number or referees may send your profile for review again.
9.4 Referees
Only list referees who have agreed to it. By listing someone, you confirm they're happy to be contacted by us and by employers you accept. Referees can ask us to remove their details at any time (see our Privacy Policy).
9.5 No fees to find work
- Househelps never pay to use KaziConnect, to apply for a job, or to be hired through it.
- No one may ask another user for a "placement", "registration", "processing" or "uniform" fee, a deposit, a loan, or any other payment as a condition of being hired or considered. If anyone does, please don't pay and report them; we will remove them.
- Never hand over your original ID card, passport or certificates to anyone you meet through the app.
9.6 Job posts
- Post only genuine, current vacancies for domestic work in a home, with a lawful salary range and honest details about the household, duties, work arrangement and off days.
- No discrimination. Posts and hiring decisions must not exclude or prefer people because of tribe or ethnic origin, religion, race, colour, disability, pregnancy, marital status, HIV status or any other ground protected by the Constitution of Kenya and the Employment Act.
- Don't include phone numbers, emails, your exact address, or children's names or photos. Describe children only by number and age.
- No jobs outside the home or outside Kenya, recruitment for other people or agencies, or anything involving unpaid "trial" work, withheld wages or confiscated documents.
- You can have a limited number of open posts at once. Posts expire after 30 days unless you renew them, and we may limit how often you post.
9.7 Requests, applications and contact details
- Phone numbers (including referees' numbers) are shared only after a househelp accepts an employer's request, or an employer accepts a househelp's application. Use them only to discuss that job, and never pass them on.
- Be respectful and honest in requests, applications and chats. Don't send repeated unwanted requests, and accept "no" as an answer.
- When you've hired someone or filled a job, mark it in the app so others aren't left waiting.
9.8 Reviews
- Only employers who have connected with a househelp through the app can review her, and only once.
- Reviews must be honest, based on your own experience, and must not include personal information, threats, or false or defamatory statements. Don't offer or accept anything in exchange for a review.
- We may remove reviews that break these rules.
9.9 Safety, disputes and serious harm
- Meet for the first time somewhere public or with someone you trust, and tell someone where you're going.
- Disputes about pay, duties, conduct or ending a job are between the employer and the househelp. We can act on reports about breaches of these Terms, but we don't mediate or decide employment disputes. Labour officers and the courts can help with those.
- We have zero tolerance for child labour, forced labour, trafficking, abuse or exploitation. We will remove anyone involved and report them to the authorities. If someone is in danger, contact the police (999 or 112) or, for a child, the National Child Helpline on 116.
10. FitMums KE (Fitness & Health Challenge)
10.1 Joining
To share transformations and check in, you must be 18 or over, accept the community guidelines shown in the app, and consent to us storing your photos and health details as described in our Privacy Policy. Anyone eligible can browse, cheer and vote; meal plans are available to all users.
10.2 Photos and transformations
- Only post photos of yourself. Never post photos of another person or of any child, and only post photos you have the right to share.
- Keep photos decent: sportswear or everyday clothes. No nudity, underwear-only or sexual images.
- Your transformation's dates, number of days and any weight change must be honest. Don't post edited, AI-generated or someone else's "after" photos.
- Transformations are private unless you choose "Public". Public transformations can be seen, cheered and voted on by other adult FitMums KE users, with your name and profile photo. You can make them private again or delete them at any time.
- We will not use your FitMums KE photos in advertising or marketing outside the app without asking for your separate, explicit permission first.
10.3 Be kind
FitMums KE is about encouragement. No body-shaming, mocking, comparing, sexual comments, or unsolicited diet or medical advice about another mum's body. Reports about this are treated seriously.
10.4 Cheers, votes, leaderboards and badges
- Each person gets one "most inspiring" vote per week and cannot vote for themselves. Cheers and votes must come from real people using their own single account.
- No fake accounts, vote trading, paying for votes, or coordinated cheering to manipulate rankings. We may remove votes, cheers, check-ins or badges, and reset or disqualify a result, if we reasonably believe they were manipulated.
- Leaderboards are calculated automatically, and our decision on any disputed ranking is final.
- Badges are recognition only. They have no cash value and can't be exchanged or transferred. If we ever add prizes to FitMums KE, the rules in Section 8 will apply.
10.5 Meal plans
- Share only meal plans you're happy for others to use. Keep nutrition figures as accurate as you reasonably can, and label them as estimates.
- Don't make medical claims (for example, that a meal treats or cures a condition), and don't promote or sell supplements, slimming products, medicines or weight-loss drugs.
- Our curated plans and all nutrition figures are general, approximate guidance only.
10.6 Not medical advice
FitMums KE content, including other users' stories, meal plans and nutrition figures, is general information for motivation. It is not medical, nutritional or fitness advice and doesn't replace advice from a doctor, nurse, midwife, nutritionist or other qualified professional. Talk to one before starting a new diet or exercise routine, especially if you are pregnant, recently gave birth, are breastfeeding, or have a health condition. Stop exercising and seek help if you feel pain, dizziness or unwell. You take part at your own risk, to the extent the law allows.
11. User Content & Conduct
You agree not to post or send content that:
- Is unlawful, defamatory, harassing, hateful, or sexually exploitative (particularly involving minors)
- Infringes someone else's intellectual property or privacy rights, including posting photos of people without their permission
- Impersonates another person or organization, or is fraudulent (including payment/withdrawal fraud, fake job posts or fake househelp profiles)
- Spreads spam, malware, or deliberately false information
- Discriminates against people on grounds protected by Kenyan law
- Attempts to manipulate contests, boosts, group subscriptions, the wallet system, KaziConnect reviews or FitMums KE votes (for example fake accounts, collusion, or exploiting bugs)
12. Moderation & Enforcement
We may review, warn about, hide, remove, or restrict content and accounts that break these Terms, whether flagged by another user's report or found through our own review. This includes hiding FitMums KE transformations and meal plans, and suspending KaziConnect profiles or removing job posts. Depending on severity, we may issue a warning, temporarily suspend, or permanently ban an account, and we may report illegal activity to the authorities. We aim to be fair and consistent, but enforcement decisions are made at our reasonable discretion. If you think we've made a mistake, contact Support.
13. Intellectual Property
You retain ownership of the content you create and post. By posting content on the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute it solely for the purpose of operating, promoting, and improving the Service (for example, showing your post in other users' feeds, or a winning contest video in promotional material with credit to your TikTok handle if provided). This license is limited for FitMums KE photos as described in Section 10.2, and for private content to storing and showing it to you. It ends when you delete the content or your account, except for copies already shared by other users before deletion. Mums Club KE's own branding, logos, and app design remain our property.
14. Third-Party Services
The Service relies on third-party providers, including Safaricom (M-Pesa payment processing) and push notification, email and hosting providers. Your use of M-Pesa is also subject to Safaricom's own terms. We are not responsible for the acts or omissions of these third parties, though we take reasonable steps to work with reputable providers.
15. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Without limiting this, we do not vouch for any user, househelp, employer or job, or for the results of any fitness or nutrition content.
16. Limitation of Liability
To the fullest extent permitted by law, Mums Club KE and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service, including from dealings with other users met through KaziConnect or from following FitMums KE content. Our total liability for any claim arising from these Terms or the Service is limited to the greater of KES 5,000 or the amount you paid us in the 3 months before the claim arose. Nothing in these Terms limits liability that cannot lawfully be limited (for example, liability for fraud or death or personal injury caused by negligence).
17. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your content, your misuse of the Service, or any employment relationship you enter into through KaziConnect.
18. Termination
You may stop using the Service and delete your account at any time from Account Settings; this also deletes your KaziConnect and FitMums KE data as described in our Privacy Policy. We may suspend or terminate your access if you break these Terms, at our reasonable discretion, and to the extent permitted by law. On termination, your wallet balance (if any) will be handled in accordance with Section 5 and applicable law — contact us using the details in Section 21 if you need to withdraw a remaining balance.
19. Governing Law & Dispute Resolution
These Terms are governed by the laws of Kenya, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Kenya, unless applicable consumer-protection law provides otherwise.
20. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you in-app. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
